Terms of Service

These Terms of Service ("Terms") govern your use of Affinity (the "Service"), provided by MyBranz, Inc. ("MyBranz," "we"). By installing or using the Service, you (the "Merchant") agree to these Terms.

1. The Service

Affinity analyzes your store's customer, order, and engagement data to produce affinity scores and to build and, at your direction, activate customer audiences to third-party platforms you connect.

2. Your responsibilities

• You must have all rights and consents necessary for us to process the data you provide or connect.
• You will only activate audiences for customers who have given the marketing consent required in their jurisdiction, and you attest that data shared with advertising platforms was lawfully collected.
• You will comply with the terms of any third-party platform you connect (Shopify, Meta, Google, etc.).
• You are responsible for credentials you connect and for activity under your account.

3. Third-party platforms

The Service integrates with third-party platforms. Your use of those platforms is governed by their terms, and we are not responsible for their availability, data practices, or actions.

4. Data & privacy

Our handling of data is described in our Privacy Policy. You remain the controller of your customers' personal data; we process it on your behalf to provide the Service.

5. Fees

Fees, if any, are presented at signup or in the app listing. You authorize the applicable billing through the platform you installed from.

6. Intellectual property

We retain all rights in the Service. You retain all rights in your data. You grant us a limited license to process your data solely to provide and improve the Service.

7. Disclaimers

The Service is provided "as is" without warranties of any kind. Affinity scores are estimates to assist your decisions and are not guarantees of customer behavior or outcomes.

8. Limitation of liability

To the maximum extent permitted by law, MyBranz will not be liable for indirect, incidental, special, or consequential damages, or for amounts exceeding the fees you paid for the Service in the prior twelve months.

9. Termination

You may stop using the Service and uninstall at any time. We may suspend or terminate access for breach of these Terms or to protect the Service.
